Terms of Service

By accessing Coastline Digital’s website, completing our onboarding forms, or using any services or systems provided by Coastline Digital, you agree to be bound by these Terms of Service. Please read them carefully before engaging our services.

1. Services Provided

Coastline Digital provides digital marketing and business automation services to local service businesses, including but not limited to:

  • Google Business Profile optimization and management
  • Missed call text-back systems
  • Automated review request and reputation management systems
  • Customer lead tracking and follow-up automations
  • SMS and email messaging setup and configuration
  • CRM onboarding and workflow automation
  • Website design, setup, and hosting
  • Related business communication and automation services

2. Client Responsibilities

By engaging Coastline Digital’s services, clients agree to:

  • Provide accurate, complete, and up-to-date business information during onboarding and throughout the service period
  • Maintain lawful business operations at all times
  • Provide timely access to required platforms and accounts when requested
  • Use all messaging, automation, and CRM systems responsibly and in compliance with applicable laws
  • Ensure all customer communications comply with applicable laws including CASL, PIPEDA, and the U.S. TCPA where applicable
  • Obtain proper, documented opt-in consent from all customers prior to initiating any automated SMS, email, or other commercial electronic communications
  • Promptly honor all opt-out requests received through any channel (e.g., STOP replies, unsubscribe requests)

3. SMS and Messaging Compliance

Coastline Digital assists clients with the setup and configuration of SMS messaging systems. By using any SMS or messaging services set up by Coastline Digital, clients acknowledge and agree to the following:

Opt-In Consent. Clients are solely responsible for collecting, documenting, and maintaining valid opt-in consent from all recipients prior to sending any automated text messages. Consent must be explicit, voluntary, and obtained through a compliant opt-in mechanism such as a web form with a clearly worded consent checkbox, a paper sign-up form, or a confirmed keyword opt-in.

Opt-Out Compliance. All messaging systems configured by Coastline Digital are set up to include compliant opt-out instructions. Recipients can reply STOP to unsubscribe at any time. Once a STOP reply is received, that contact is automatically blocked from receiving further messages at the carrier level via Twilio. Clients must not attempt to re-message opted-out contacts without re-established consent.

Message Content. Clients are responsible for the accuracy, legality, and appropriateness of all messages sent through systems Coastline Digital configures. Messages must not contain misleading, deceptive, or prohibited content as defined by carrier guidelines and applicable law.

No Sharing of Consent Data. Client contact lists and customer consent data must not be shared with, sold to, or used by any third-party organizations, parent companies, or affiliates for marketing purposes. Coastline Digital does not share customer contact data with any third parties for marketing.

4. Third-Party Platforms

Certain services provided by Coastline Digital rely on third-party platforms including GoHighLevel, Twilio, and Google. Coastline Digital is not responsible for service interruptions, policy changes, outages, or limitations caused by third-party providers. Clients are encouraged to review the terms of service of each applicable platform.

5. No Guarantee of Results

While Coastline Digital works diligently to improve your business’s communication systems and online presence, we do not guarantee any specific outcomes. Results vary depending on factors including the competitive environment of your business, market conditions, platform algorithm changes, and customer responsiveness.

6. Payments and Billing

Payment terms and pricing are agreed upon prior to commencement of services and include a one-time setup fee and a monthly retainer, which becomes active once all systems are fully configured and activated. Payments are processed securely through Stripe.

SMS usage fees and platform costs are billed directly to the client through GoHighLevel and are not included in Coastline Digital’s monthly retainer. Clients are responsible for connecting a valid payment method within GoHighLevel to cover these usage-based costs.

7. Termination

Coastline Digital reserves the right to suspend or terminate services immediately if a client engages in misuse, unlawful activity, violation of carrier or platform policies, or any material breach of these Terms. Clients may terminate services in accordance with the terms outlined in their individual service agreement.

Upon termination, client access to systems configured by Coastline Digital will be revoked in an orderly manner and client data will be handled in accordance with our Privacy Policy.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Coastline Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use our services, including loss of revenue, business opportunities, data, or goodwill.

Coastline Digital’s total liability to any client shall not exceed the total fees paid by that client in the three months preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Coastline Digital, its owners, employees, and contractors from any claims, damages, liabilities, costs, and expenses arising out of: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation including messaging and anti-spam laws; or (d) any unauthorized or non-compliant communications sent through systems we configure on your behalf.

10. Governing Law

These Terms of Service are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of British Columbia.

11. Changes to These Terms

Coastline Digital may update these Terms periodically. Updated versions will be posted on this page with a revised date. Continued use of our services following any updates constitutes acceptance of the revised terms.
